TOWNSHIP OF PEQUANNOCK

REGULAR MEETING

November 25, 2008

 

 

Time & Place The minutes of the Regular Meeting of the Pequannock

Township Council, County of Morris, New Jersey, held November 25, 2008, in the Municipal Building.

Present The meeting was called to order at 7:30 P.M. with the following present: Mayor Kapotes, Councilmen Engelbart,

Jorgensen, Skvarca, Vanderhoff; Attorney Oostdyk;

Acting Manager Correale and Township Clerk Sweeney.

Mayor Kapotes announced that requirements of Public

Law c.231 have been complied with for this meeting

through notice of date, time, place and proposed Agenda being posted in the Municipal Building and mailed to 5 area newspapers, including the Official Township

newspaper.

Minutes Motion by Vanderhoff, second by Engelbart that the

following minutes be approved as presented:

Regular Meeting - October 28, 2008

Closed Meeting - October 28, 2008

On roll call five members voted yes and the motion

carried.

Motion Vanderhoff, second by Jorgensen that the

following minutes be approved as presented:

Special Meeting - November 11, 2008 On roll call five members voted yes and the motion

carried.

Public Discussion Anthony Franchino - 21 Lyman Avenue - Pequannock

Spoke about a water pipeline which runs along the

ditch at the end of Lyman Avenue. He said that a neighbor

backing up his car hit the ditch and almost hit the

pipeline. He suggested that something be installed

to protect the pipeline.

RESOLUTION

Ord. #2008-33 RESOLVED That an Ordinance entitled:

Introduction AN ORDINANCE AMENDING CHAPTER 189 OF THE

REVISED GENERAL ORDINANCES OF THE TOWNSHIP

OF PEQUANNOCK AND ESTABLISHING LAND USE

REGULATIONS FOR WIRELESS COMMUNICATION

TOWERS AND ANTENNAS.

RESOLVED That the Ordinance as read by titled be

passed on first reading and notice thereof, together with

the Ordinance be advertised in Suburban Trends for final

reading and public hearing at a Regular meeting of the

Township Council to be held at the Municipal Building

on December 23, 2008, at 7:30 P.M. prevailing time.

Motion by Jorgensen, second by Skvarca.

On roll call five members voted yes and the motion

carried.

 

 

RESOLUTION

Ord. #2008-34 RESOLVED That an Ordinance entitled:

Introduction AN ORDINANCE AUTHORIZING THE UNDERLYING

AMENDMENTS TO THE VARIOUS SERVICE CONTRACTS

AND AGREEMENTS BETWEEN TWO BRIDGES SEWER

AUTHORITY AND ITS MEMBERS.

RESOLVED That the Ordinance as read by title be

passed on first reading and notice thereof, together with

the Ordinance be advertised in Suburban Trends for final

reading and public hearing at a Regular meeting of the

Township Council to be held at the Municipal Building

on December 23, 2008, at 7:30 P.M. prevailing time.

Moved by Vanderhoff, second by Jorgensen.

On roll call five members voted yes and the motion

carried.

 

RESOLUTION

Ord. #2008-36 RESOLVED That an Ordinance entitled:

Introduction ORDINANCE APPROPRIATING $28,400.00 FROM

THE CAPITAL RESERVE FOR VARIOUS CAPITAL

IMPROVEMENTS AND EQUIPMENT PURCHASES IN

AND BY THE TOWNSHIP OF PEQUANNOCK IN THE

COUNTY OF MORRIS, NEW JERSEY.

RESOLVED That the Ordinance as read by title be

passed on first reading and notice thereof, together with

the Ordinance be advertised in Suburban Trends for final

reading and public hearing at a Regular meeting of the

Township Council to be held at the Municipal Building

on December 23, 2008, at 7:30 P.M. prevailing time.

Moved by Vanderhoff, second by Engelbart.

On roll call five members voted yes and the motion

carried.

RESOLUTION

Ord. #2008-37 RESOLVED That an Ordinance entitled:

Introduction ORDINANCE AMENDING THE REVISED GENERAL

ORDINANCE OF THE TOWNSHIP OF PEQUANNOCK

AND PROVIDING FOR THE ISSUANCE OF PERMITS

FOR THE PLACEMENT OF CLOTHING BINS WITHIN

THE TOWNSHIP.

RESOLVED That the Ordinance as read by title be

passed on first reading and notice thereof, together with

the Ordinance be advertised in Suburban Trends for final

reading and public hearing at a Regular meeting of the

Township council to be held at the Municipal Building

on December 23, 2008, at 7:30 P.M. prevailing time.

Moved by Engelbart, second by Jorgensen.

On roll call five members voted yes and the motion

carried.

 

RESOLUTION

Ord. #2008- 31 RESOLVED That an Ordinance entitled:

Adoption ORDINANCE AMENDING THE REVISED GENERAL

ORDINANCES OF THE TOWNSHIP OF PEQUANNOCK

AND ESTABLISHING REGULATIONS FOR SECONDHAND

PRECIOUS METALS, GEMS AND JEWELRY DEALERS.

Mayor Declares the meeting open and calls on Council and

citizens for comments.

 

 

 

Close Meeting Motion by Mayor to close the hearing.

RESOLVED That the Ordinance be passed on final

reading and adopted, and that notice of its final

passage be published in the subsequent issue of

Suburban Trends.

Moved by Vanderhoff, second by Skvarca.

On roll call five members voted yes and the motion

carried.

RESOLUTION

Ord. #2008-32 RESOLVED That an Ordinance entitled:

Adoption AN ORDINANCE TO AMEND CHAPTER 079 ENTITLED,

"FEES" OF THE CODE OF THE TOWNSHIP OF

PEQUANNOCK.

Mayor Declares the meeting open and calls on Council and

citizens for comments.

Close Meeting Motion by Mayor to close the hearing.

RESOLVED That the Ordinance be passed on final

reading and adopted, and that notice of its final

passage be published in the subsequent issue of

Suburban Trends.

Moved by Engelbart, second by Vanderhoff.

On roll call five members voted yes and the motion

carried.

 

RESOLUTION

Ord. #2008-35 RESOLVED That an Ordinance entitled:

Adoption BOND ORDINANCE PROVIDING A SUPPLEMENTAL

APPROPRIATION OF $710,000 FOR THE SANITARY

SEWER EXTENSION PROJECT IN AND BY THE

TOWNSHIP OF PEQUANNOCK, IN THE COUNTY OF

MORRIS, NEW JERSEY AND AUTHORIZING THE ISSUANCE

OF $674,500 BONDS OR NOTES OF THE TOWNSHIP FOR

FINANCING PART OF THE APPROPRIATION.

Mayor Declares the meeting open and calls on Council and

citizens for comments.

Close Meeting Motion by Mayor to close the hearing.

Motion by Vanderhoff, second by Engelbart to have

Ord. #2008-35 carried to the Special Meeting of

December 9, 2008, for final adoption.

On roll call five members voted yes and the motion

carried

Consent Agenda Anything placed on this agenda has been deemed to be

non-controversial and a matter of routine business and

will be voted on by one motion.

Motion by Vanderhoff, second by Jorgensen.

On roll call five members voted yes and the motion

carried.

Addendum 9.1 Resolution - Approving expenditure of monies by

dedication by rider to pay Expenditures for the

Fire Safety Official as per N.J.S.A. 40A:4-39.

Addendum 9.2 Resolution - Approving the insertion of an item

of revenue in the 2008 Budget in the sum of

$589.00 under the caption Alcohol Education

Rehab. Enforcement.

Addendum 9.3 Resolution -Accepting the Farm Road Sanitary Sewer Project and releasing the Performance Bond in the amount of $23,148.95.

Addendum 9.4 Resolution - Authorizing the Reduction of the

Performance Guarantee for Erickson Retirement

Communities/Cedar Crest Village from $1 Million

to $50,000 and releasing the remainder.

Addendum 9.5 Resolution - Accepting the Complete and

Permanent Release and Agreement between

the Township of Pequannock and Kevin F. Boyle.

Addendum 9.6 Resolution - Authorizing an Interlocal Service

Agreement between the Township of Pequannock

and the County of Morris for Computer Aid

Dispatch and Records Management.

Addendum 9.7 Resolution - Awarding the Bid of the Heavy Duty

Rescue Fire Apparatus to Pierce Manufacturing of

Appleton, Wisconsin in the amount of $455,165.00.

Addendum 9.8 Resolution - Rejecting all Bids for the Historic

Restoration and Bathroom Renovations for the

Pompton Plains Railroad Station.

Addendum 9.9 Resolution - Canceling various Accounts Payable

charges.

Addendum 9.10 Appointing David W. Hollberg as Township

Manager of the Township of Pequannock

effective January 1, 2009.

9.11 Approval - George V. Fournier, Jr. to the Rolls

of Company No. 2.

9.12 Approval - Scott Berkenbush to the Rolls of

Company No. 2.

9.13 Approval - Roy J. Berghuis to the Rolls of

Company No. 1.

9.14 Approval - Katherine J. Young to the Rolls of

Company No. 1.

9.15 Approval - Various Credits, Refunds & Redemptions
